Terms of Service

These Terms of Service ("Terms") govern your use of the SugarBye website, Telegram Mini App, bot, and related services (the "Service"). The Service is provided by IP Samokhin Konstantin Aleksandrovich (Individual Entrepreneur), Russia, doing business as SugarBye ("SugarBye", "we", "us", or "our"). By using the Service, you agree to these Terms.
1. Eligibility and account
The launch market is the United States. You must be at least 18, have reached the age of majority under applicable law, and be legally able to enter into a contract. Before new label checks, plan creation or purchases, you must confirm adulthood, agree to these Terms and acknowledge the Privacy Policy. Country confirmation is not requested. This is a self-declaration, not identity verification. You must provide accurate information and stop using these features if you no longer meet the age or contractual-capacity requirements. You are responsible for the security of your platform account.
Parents may check packaging using their own adult account, but must not submit children's personal data. Results do not establish a product's suitability for a child. Existing users can still access support, refunds and profile data controls without making the declaration.
2. What the Service provides
SugarBye is a digital wellness and education service designed to help users understand added sugar, review food-label information, and follow a structured 30-day habit-building program. The Service may provide AI-assisted plans, explanations, reminders, product information, and suggested alternatives.
The Service is not a medical service, medical device, diagnostic tool, treatment, or substitute for a licensed healthcare professional. See the Medical Disclaimer.
3. AI-assisted results
Some results are generated or assisted by automated systems. They may be incomplete, inaccurate, outdated, or based on an uncertain label reading. You should check the original packaging and use your own judgment. Do not rely on the Service for decisions involving a serious medical condition, medication, insulin, allergies, pregnancy, eating disorders, or any urgent situation.
4. Acceptable use
You agree not to misuse the Service, interfere with its operation, bypass access limits, probe or attack its systems, upload unlawful or harmful content, infringe another person's rights, impersonate another person, or use the Service to provide professional medical advice to others.
5. Paid access and Telegram Stars
The Service may offer a one-time purchase for 30 days of access to selected paid features. The price, currency, included features, and purchase conditions are shown before payment. Digital purchases within Telegram are processed through Telegram Stars. Telegram may apply additional terms.
The launch offer is 500 Telegram Stars (XTR) for 30 days. Paid access includes up to 10 new label checks per calendar day in total; free access includes 2. Limits reset at midnight in the time zone selected in your profile. Reopening a successfully analyzed identical image does not use another check. Failed analyses do not use a check. Days 1–7 of the habit programme are free; days 8–30 require active paid access. The plan calendar runs from the original plan creation date and is not restarted by a purchase. Repeat purchases add 30 days after any remaining paid period. There is no automatic renewal. The monetary cost of acquiring Stars may vary; 500 Stars is not a fixed US-dollar price.
Access is activated only after successful payment confirmation. Purchases are not automatically recurring. For payment support or refund requests, contact https://t.me/ksamokhinn or send /paysupport to @SugarByeBot and include your payment receipt. Support for these purchases is provided by SugarBye, not Telegram. Refunds are handled in accordance with applicable law and the payment provider's rules. A refund revokes the access period associated with that purchase. Other already purchased periods retain their original start and end dates.
6. Intellectual property
The Service, including its software, design, text, branding, databases, and content, is owned by or licensed to SugarBye and is protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes while you comply with these Terms.
You retain rights in content you submit, but you grant us the limited rights needed to host, process, analyze, secure, and display that content to provide and improve the Service, as described in the Privacy Policy.
7. Third-party services
The Service may depend on Telegram, hosting providers, AI providers, payment providers, and other third parties. Their availability and terms are outside our control. We are not responsible for third-party services or content.
8. Availability and changes
We may modify, suspend, or discontinue features, including free or paid features, for maintenance, security, legal, or business reasons. We will make reasonable efforts to communicate material changes where required. We do not guarantee uninterrupted or error-free availability.
9. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available." SugarBye disclaims warranties of accuracy, fitness for a particular purpose, non-infringement, availability, and any guaranteed health or behavioral outcome. Individual results vary.
10. Limitation of liability
To the maximum extent permitted by law, SugarBye will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or opportunity, arising from your use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded.
11. Suspension and termination
We may suspend or terminate access if you materially breach these Terms, create security or legal risk, or misuse the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.
12. Governing law and disputes
These Terms are governed by the laws of [country/state], excluding conflict-of-law rules. Courts located in [place] will have jurisdiction, unless mandatory consumer-protection law provides otherwise. If you are a consumer, you may also have rights to bring a claim in your country of residence.
13. Changes to these Terms
We may update these Terms by posting a revised version and changing the date above. If a change materially affects your rights, we will provide additional notice where required. Continued use after the effective date means you accept the revised Terms.
